Red flags fly for me if a company makes false statments. You can't be sold out of something if you haven't sold any of product to begin with. If it's true they haven't sold to the general public, then it should be made clear. Otherwise, sold out could mean they made ten of the controllers and sold them to friends. Not saying so, implies that the product has been sold to the general public and they do say they have had at least one production run. Again, implying sales to the general public.
The wording is misleading at least, although this may not have been intentional on the company's part.

This misleading kind of marketing strongly suggests there's something wrong with the product.
