David R Foley about to have a vacation!

It sure don't sound pretty. So you're saying GVR bought a pig in a poke and the suposed assets stated as being received by GVR in the findarticles story were never received?

Beware, humble readers:

Mr Foley quite interestingly uses the language "GVR never paid for the agreed upon purchase of UltraCade" when in fact he liquidated the company to receive money for Ultracade assets without fulfilling obligations to creditors. A bankruptcy sells assets to fulfill liabilities, Foley just sold off assets and screwed his creditors.

This is called, having your cake and eating it too.

Unfortunately, you know not of which you speak. I am the single largest creditor of UltraCade Technologies and stand the most to loose by Sherwood failing to meet their obligations to collect from GVR.

That is correct.

So the manufacturing assets were taken away from both GVR and you by Sherwood? Who did Sherwood sell them to or were they put in a holding trust? Did GVR gain possession later?

How did GVR manage without the goods?

It will be clear during the coverage of the case.

Thanks for not answering my question.

Once again it becomes obvious that bothering in VP World is mostly a complete waste of time,...

@ everyone else:

I would have had the perfect solution for the VP8/9 problem, which means a user could not have loaded a table into the wrong VP version anymore. Therefore a non-interfering co-existence of both versions (including file-association with the right one) would have been possible too. Unfortunately the people who could implement it dont seem to be interested so the problems will remain as known.

That's actually not true, we are interested, it's just the programmer who will implement this is working on another project at the moment.

Aha, and you didnt tell me so because?

You see its not like im impatient or anything, its just that ive been waiting a whole month for a response of any kind and got none whatsoever. And when i asked here whether the mail got through you still did not respond even though you had the time to write three posts.

So you will please forgive me if that didnt give me the impression that you were interested. I have made proposals before you know and usually if somebody is interested you get at least some kind of reponse. So far all i got was static, and that usually hints at a 'tell somebody who cares' attitude,...

As you probably know, I've been a little "preoccupied" with some rather big issues, so getting onto the forums had to take a back seat.

I understand that. Im not in the forums every day either.

What i do not understand is why a whole month has passed without a reply to my email, (for which you wouldnt have had to visit any forums), and why you had the time to write several posts in this thread, yet not the two minutes to answer my query.

But thats alright, really, it is, and i wont ask anymore either. Sometimes it is best to let something be and that is what i am going to do now. Good Luck with your lawsuit and your future endeavors.

Complications

Hi David,

As I stated before, my understanding is that the ABC process has a reputation of being used by companies to "legally" defraud creditors via its speed and lack of oversight/recourse.

Since the Ultracade transfer involved only 3 parties (your company, the legal representative (sherwood) and the third-party acquiring assets (GVR): inquiring minds wonder what legal entity, judge or arbitrator represented and negotiated for the rights of the creditors of Ultracade? The answer is NO ONE.

In a bankruptcy, an arbitrator or judge is the objective third-party who must receive and approve any planned liquidation plan after hearing arguments from creditors. The ABC route you took lacked any objective party overseeing the settlement, so it is of no surprise that the "creditors" are crying foul.

Now, because of your bad reputation I can't believe everything you say---but if you are being truthful: Global VR had your cake and ate it too.

Do you have any involvement in the Federal Copyright Case Against Hanaho Games and Chicago Gaming Company? I see they are selling the Ultimate Arcade, which is some derivative of your Ultracade: http://dockets.justia.com/docket/court-cacdce/case_no-2:2007cv08150/case_id-403274/

After experiencing what GVR and Sherwood did with the ABC, I would agree with your assessment of the process.

No. That case was settled a couple of years ago. I'm familiar with it, but not involved. Capcom has only ever licensed two people the rights to the classic library, me and Conway Ho. We used to provide the Arcade Legends system to Chicago Gaming. When GVR took over, they thought they could raise the price and steal away business from Chicago Gaming. The plan backfired. Instead of buckling to the pressure, Chicago Gaming just went to HanaHo and had them build a replacement for our system. And since Conway had the rights to the Capcom games, they could do it. Now, Capcom Japan and Capcom USA had disputes over the classic library. I had licnesed my games from Japan, while Conway had from Capcom USA. Capcom management was trying to revoke Conway's license, but they couldn't and a legal battle ensued. As an effort to put pressure on Conway, they also filed a criminal complaint (sound familiar to my current situation?) In the end, Capcom and Conway settled, and the charges were dropped.

Is that Company that was talking about selling a UltraPin like system with GTS3 games tied in to this?

Also there was this other multi game system with neo geo games and other systems with long load times. By a no name company I have a few old poor cell phone pics of it.

Those are pictures of a system from Europe called Cristaltec. They were around for a couple of years. They have no relationship to HanaHo.

Thanks for the info I tried Google for it in the past and did not find any.

It looks a little like some kind of a slot game with out the pay out hopper.

I'll look around. I used to have their brochure back in the UltraCade days, but I haven't dealt with them in the last 6 years or so.

the "article" is full of misstatements and unfounded claims. The author didn't attempt to actually report, instead, used calculated contacts based on inside information to get the answers he was looking for. There are many examples of companies quoted in his article that had done direct licensing deals for the games in question, he just didn't bother to ask any of the people or companies involved in the licensing, rather identified people and/or companies that that were not involved or did not even own the rights at the time they were licensed and asked them. Notice the quotes say things like "don't remember" Also, many of the companies had US branches, and none of those people were interviewed. If the author claimed to have done all of this research in 2006, why didn't he publish any of it then, or contact me then, instead waiting for an indictment to come down and then publishing it. Clearly he is a front for those attempting to ruin my reputation.

Of course i meant no disrespect, (its probably best to wait until this is over), its just that the article has a lot of stuff that sounds well reseached, therefore plausible and convincing, and all this together sort of pictures you and Michael in a very, very bad light.

Right now all the evidence (edit: as provided in that article) seems to be speaking against you,...curious what Mr. Cheng will make of this,...

none of this article is "evidence" No evidence in the case has actually been presented. That is done at trial. Reporters, and I use the term very loosely, don't provide evidence, that's done by the prosecutor. What this article is, is simply hearsay.
